Meet With Us

We will meet at a time and place convenient for you. We will discuss your dispute with the insurer and the relevant policy and ask questions about the desired outcome of the dispute.

Gathering information

We will gather information such as the insurance policy and any correspondence you have had with the insurer so far to determine the merit of your case. We will review the law that applies to your individual circumstances.

Write to the insurer

If we believe your case has merit, we will write to the insurer and set out the basis in which your claim should be reviewed. We will provide them with a time limit in which they must respond. If they do not respond to our letter, we will consider commencing proceedings in Court.

Review response and negotiate

We will hope to receive a response from the insurer setting out in detail the reasons why they refuse the claim. They may wish to negotiate a resolution with you rather than proceed to expensive litigation. If we receive an offer to negotiate a resolution with them, we will seek your instructions first. If we are unable to negotiate a resolution or the insurer continues to deny the claim, we will need to consider commencing Court proceedings.

Consider commencing Court proceedings

If the insurer continues to deny the claim, and we believe your claim has merit, we will advise you as to the risks and benefits of commencing proceedings in Court against the insurer. This can sometimes be a lengthy process. Once we have answered all of your questions, it will be up to you to decide how you would like to proceed.
